What actually changed in Texas
Hemp law in Texas moved fast in 2026, and most of the confusion comes from the fact that the rules changed, got paused by a court, and then came back. Here is the short version, in order:
- September 2025 Executive Order GA-56 directs the Texas Department of State Health Services to tighten the rules covering consumable hemp products.
- March 31, 2026 The DSHS consumable hemp rules take effect. Smokable hemp products — including flower and pre-rolls — are prohibited at retail. The rules also redefine "total THC" so that THCA counts toward the THC limit, which high-THCA flower cannot meet.
- May 1, 2026 A Travis County court grants a temporary injunction, briefly pausing enforcement.
- June 6, 2026 The Texas Fifteenth Court of Appeals declines to keep that injunction in place, and the rules return to force.
- July 31, 2026 Texas begins enforcing Schedule I controlled substance definitions covering manufactured delta-8, delta-10 and THCP.
The practical upshot for shoppers: smokable hemp flower is the part that went away. The restriction is about the format and the THC math, not about hemp in general — which is why edibles and other categories are still on our shelves.
Coming to our shelves: Delta-9 and CBD flower, done properly
We are working on it. Our team is working with licensed suppliers to bring Delta-9 and CBD flower options to the Fort Worth store, and we will stock them as soon as they can be offered in full compliance with Texas requirements — lab documentation and all.
We are deliberately not announcing a date. Nothing goes on our shelf until the compliance paperwork is solid. If you want to know the moment it lands, call (817) 479-3162 or ask the team on your next visit and we will let you know.

Frequently asked questions
Is THCA flower legal in Texas in 2026?
Not for retail sale. The DSHS consumable hemp rules that took effect March 31, 2026 prohibit smokable hemp products — flower and pre-rolls included — and redefine total THC so that THCA counts toward the limit. High-THCA flower cannot meet that standard. This rule has been litigated through 2026, so check the current status before relying on this summary.
Why did Basswood stop carrying THCA flower?
We pulled smokable hemp flower and pre-rolls to stay on the right side of the Texas rules. We would rather lose a category than sell something a customer could get in trouble carrying.
When did the Texas smokable hemp ban take effect?
March 31, 2026. A Travis County court granted a temporary injunction on May 1, 2026, but the Texas Fifteenth Court of Appeals declined to keep it in place on June 6, 2026, putting the rules back in force. Separately, Texas began enforcing Schedule I definitions covering manufactured delta-8, delta-10 and THCP on July 31, 2026.
Can I still buy THCA edibles or gummies in Fort Worth?
Yes. The smokable hemp restriction targets flower and pre-rolls. We still carry edibles, gummies and chocolates at 5601 Basswood Blvd STE 145. Call (817) 479-3162 to confirm stock before you drive over.
Will Basswood carry hemp flower again?
We are working with licensed suppliers on Delta-9 and CBD flower options and will stock them as soon as they can be offered in full compliance with Texas requirements. No date yet — we will not put anything on the shelf before the compliance paperwork is solid.
What can I buy instead of THCA flower?
Most customers move to gummies and edibles, or to our disposable vape and premium cigar selection. We also carry kratom, CBD and hookah supplies. Walk in and the team will help you find the closest match.
Where is Basswood Vape & Cigar located?
